The defendants include, without limitation, Continental, Michelin, Nokian Tyres, Goodyear, Pirelli, and Bridgestone. In essence, the class action alleges that these companies colluded to inflate or otherwise stabilize the prices of replacement tires for passenger vehicles sold in the United States.
Plaintiffs allege that these tire companies colluded to exploit market conditions post-COVID-19, leveraging high barriers to entry, market concentration, and inelastic demand to dramatically and unlawfully raise tire prices. It is alleged that this conduct constitutes a per se violation of the Sherman Antitrust Act (15 U.S.C. § 1) and various state antitrust and consumer protection laws.
